These Terms of Service (“Terms”) govern your use of this website and any purchase you make through it (the “Services”), operated by Alpha Gem Collectables. By using the Services or placing an order, you agree to these Terms. If there's a conflict between these Terms and our Privacy Policy, Returns & Refund Policy, or Shipping Policy on a specific topic, the more specific policy controls for that topic.

1. Who We Are

2. Orders and Contract Formation

● Placing an order is an offer to purchase, which we may accept or decline. A contract is formed when we confirm your order (for example, by sending an order confirmation email), not when the order is placed or paid for.

● We may decline or cancel an order at our discretion — for example, where stock is unavailable, pricing is incorrect, or we suspect fraudulent activity — in which case we'll provide a full refund for that order.

● Occasionally a product may be listed with an incorrect price or description due to a genuine error. If this happens, we'll contact you before proceeding and you can choose to continue at the correct price or cancel for a full refund.

3. Pricing and Payment

● All prices are in Australian dollars and include GST where applicable.

● We take reasonable care to display accurate pricing and stock availability, but errors can occur, particularly for fast-moving collectible and trading card markets.

● Payment is required in full at the time of ordering unless otherwise agreed.

4. Consumer Guarantees and Your Rights

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (ACL). Where goods are faulty, not of acceptable quality, not fit for purpose, or don't match their description, you're entitled to a remedy — see our Returns & Refund Policy and Shipping Policy for how we handle these situations in practice.

5. Limitation of Liability

To the extent permitted by law, and subject always to your rights under the Australian Consumer Law, we exclude liability for indirect or consequential loss, and our liability for any claim relating to the Services is limited to the amount you paid for the relevant order. This limitation doesn't apply to, and can't override, any consumer guarantee you're entitled to under the ACL.

We're not liable for website downtime, errors in content, or issues arising from third-party sites we link to. We take reasonable steps to keep the site accurate and available, but we don't guarantee it will always be error-free or uninterrupted.

6. Intellectual Property

All content on this site — including product photos, descriptions, logos, and site design — belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or reuse this content for commercial purposes without our permission.

7. Acceptable Use

You agree not to misuse the Services — including attempting to interfere with the site's operation, using automated tools to scrape pricing or stock data, or placing orders in bad faith (for example, fraudulent or speculative bulk orders intended to disrupt stock availability for other customers).

8. Account Security

If you create an account with us, you're responsible for keeping your login details secure and for activity that occurs under your account. Let us know straight away if you suspect unauthorised use.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or in Australian law. We'll post the revised Terms here and update the ‘Last updated’ date above. Continued use of the Services after an update means you accept the revised Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and any dispute is subject to the exclusive jurisdiction of the courts of New South Wales.
